Warranty

LIMITED WARRANTY 

This Limited Warranty (this “Warranty”) is made by James+James LLC, an Arkansas limited liability company (the “Company”, “we”, or “our”) and extends only to [CUSTOMER as the original purchaser(s) of the Product (as defined below).   

  1. Warranted Product.  Subject to the limitations and exclusions below, this Warranty covers defects in materials and workmanship of the solid wood products purchased by you from the Company for as long as you retain sole ownership of the Product. This Warranty does not extend to any subsequent owner or other transferee of the Product.  
  2. Limitation of Warranty.  This Warranty does not cover any damage due to: (a) transportation after the initial delivery from James & James or our logistics agents; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear; or (h) external causes such as sun damage, accidents, abuse, or other actions or events beyond our reasonable control. 
  3. Disclaimer. EXCEPT FOR THE WARRANTY SET FORTH IN SECTION 1 ABOVE, THE COMPANY MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE PRODUCT, INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY; OR (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE. 
  4.  Remedies under Warranty. In the event the Product is defective, we will, in our sole discretion, repair or replace the Product (or the defective part) free of charge We will also pay for shipping and handling fees to return the repaired or replacement product to you if we elect to repair or replace the Product.

  6. Limitation of Liability. THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY RELATING TO THE PRODUCT. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.
